occurred here in these bushes on north point between taylor and mason. look at this video around 3 a.m. the person you are seeing on the stretcher is suspect. police found him and the girl in this area near north point and taylor basically in the -- as the assault was ongoing after her friends called police to report her missing. >> the reporting party was a group who had separated from this missing juvenile early in the evening. during the time of incident the missing juvenile separated from the group on her own volition. >> reporter: that's the official word from the spokesman from the sergeant this morning. earlier at the scene, the police did tell us the victim is a 15-year-old girl and a tourist here with a tour group

and she was in fact sexually assaulted. again, the investigation is ongoin police are still interviewing witnesses trying to determine exactly what happened out here in the wee hours of the morning. the victim's injuries are not life-threatening. the suspect was taken to the hospital, complaining of pain. a lot of questions still to be answered. we will bring them as soon as we get them. katie marzullo, abc7 news richmond police searching for the gunman who opened fire on a car killing a college student. the victim's sister narrowly escaped. this happened outside their home. amy hollyfield is live in richmond with the details. >> reporter: police say as far as they can tell the victim was not involved in any gang or drug activity. they don't think he knows his killer. police and neighbors of murder victim edwin martinez, agree, he was in the wrong place at the wrong time >> he was just out there to be out there. he got caught up in the wrong

time. >> reporter: investigators think the killer was after someone else. they have no idea why he turned his gun on martinez. >> we don't have any indication that he was picked out particularly. we are still asking for help from the pub in regards to this incident. >> reporter: investigators say the -- the 22-year-old contra costa college student was this car with his sister parked in front of their apartment complex 7:00 last night. someone came running didn't the street chasing after a car and shooting. when the man gave up and stopped running, he turned and saw martinez and his sister, sitting in their car. he fired and shot martinez, several times. >> he was my neighbor, one of my friends. it is like -- [ unintelligible ] that's cold what they did. >> reporter: the neighborhood nevin and 22nd in richmond is

on edge. people who spoke didn't want to give their names. >> i feel bad for the young man's sister. feel bad for the neighborhood because too much of that type of thing goes on around here. >> reporter: one man came over to check on his mom who watches his kids pore him during the day. >> my concern is when i bring my kids over, i -- i want to know -- >> reporter: people are concerned because the killer is still on the loose. >> we don't have any information about a suspect. the description we have is very vague. >> reporter: police say all they have to go on is a man was seen running from the area. they need help. they are hoping that someone with key details will come forward. amy hollyfield, abc7 news. this morning we are learning san francisco police are trying to determine if any of the city's old cold case murders are linked to a serial killing suspect. investigators say they are examining several open

homicides to determine if 78-year-old joseph naso is responsible. yesterday he was ordered to stand trial for the murders of two bay area women in the 70s and two women in the 90s. the new investigation began after prosecutors revealed a cryptic list kept by naso that made reference to 10 women, including a reference to an apartment building in the tenderloin neighborhood. residents on the peninsula warned of a new scheme with thieves posing as door-to-door magazine salespeople. sunday night in san carlos a man and woman entered the home after using the bathroom they took jewelry from that home. deputies are urging everyone especially those in san carlos not to let solicitors into your home. the pleasantdistrict will decide whether to bring in drug -- police sant ton

district will -- critics say the proposal is a violation of privacy. the meeting begins 7:00 tonight at the district offices. plans to build and plans to block. a new stadium will be a top issue tonight. yesterday officials said opponents had collected enough petition signatures to put the future of the project back on the ballot. voters approved it in 2010. we are told -- but were told it would be at much less cost. city attorneys say the approval should stand. now councilmembers acting as the stadium authority will weigh in both sides expect the whole thing to end up in court with tomorrow oakland city officials will begin closely examining her new budget including cuts to make up for the loss in 28 million dollars in redevelopment agency funds. the mayor says the equivalent

of 105 fulltime positions will be eliminated, 50 fewer than projected last week. the mayor says officials managed to trim the number by reorganizing and consolidating several departments. >> we are going to have less departments, less administrators and in the end, we did our best to make sure that there are no cuts or minimal cuts to core services. in addition to wholesale cuts to redevelopment including afford housing programs, the budget includes less funding for community center hours, public works, subsidies to the children's zoo and aquatic center. libraries and services for the homeless and seniors won't face cuts. final decision on this budget is due next week. mitt romney and newt gingrich are stepping up attacks on each other before the critical florida primary next week. a new poll shows the infighting overtax returns and ethics may be taking a toll on

both gop front-runners. scott goldberg reports. >> reporter: no longer the front-runner and forced to disclose more information sooner than he would have liked mitt romney released two years of tax details. his 2010 return and 2011 estimate say romney earned more than 42 million dollars over that period. romney gave seven million dollars to charity over those two years, more than half to the mormon church and paid six million dollars in taxes. that means romney's tax rate is about 14%. his taxes would be much higher if his income came from a but instead it is from investments. >> i pay all the taxes that are legally required and not a dollar more. >> reporter: romney made no apologies last night in florida. this morning democrats were all too happy to weigh in. >> we need to mick shower -- make sure that middle class workers are not paying more than people making 100 million dollars a year.

>> reporter: romney tried opportunity takes on gingrich after he disclosed he made hundreds of thousands working for freddie mac. romney call it lobbying. >> you just jumped a long way over here friend. >> another area of influence peddling. >> no. >> reporter: a new poll says romney's favorability rating is 31%. 49% view him unfavorably. 29% of those surveyed view gingrich favorably his unfavorable number is 51%. that same poll has better news for president obama. 53% of the people surveyed view him favorably that puts a little wind at his back heading into the state of the union address tonight. scott goldberg, abc news a washington. >> during tonight's address the president is expected to endorse a tentative deal toerhay under the agreement one million homeowners could have the size of their mortgages reduced.

the oakland ballet is delaying the launch of its spring season do to a $90,000 shortfall in its budget. ticket sales from the 2011 nutcracker fell below expectations. the company has face mad juror financial challenges in recent years. the spring program was set to begin may 18th. the new launch date will be decided after the annual benefit gala on may 5th. a movie shot in oakland is among this year's oscar nominees. the nominations announced this morning. diane avellar reports from hollywood on this year's surprises and snubs.

engineers are out today at san francisco's telegrah hill where a rockslide drove several out of their homes yesterday. heavy rains cause two slides no one was hurt boulders slammed into a parked car next to a condo. residents of the three units closest to the hillside were evacuated. they might be allowed to return today. crews worked into the night to up stall a protective barrier with fencing. it is -- only temporary. >> might involve drilling in some sort of bolts into the hillside and adding some netting much closer on the face of the hill. >> the city says it is going to be working with the owner

to determine who is responsible for shoring up that hillside. stunning pictures this morning. a dramatic rescue of a snowmobileer trapped by an avalanche in washington state sunday. a group of friends out snowmobileing in king county. the avalanche begins you see the snow coming down. in seconds it swallows up one of the vehicles and its rider. a member of the group saw it happen and knew exactly where the man was buried. they dug frantically with their hands and shovel and once the man's helmet was able to pull him to safety. the victim says he owes his life to those friends, and he does. washington state got a lot of snow. in the last week our totals are impressive time absolutely snow pack getting bigger. unfortunately, all that snow going back up towards washington and oregon. it is impressive. we talked about how would it look white this week there you go easier to ski up there now many more runs are open make sure you check ahead i'm sure
